Under established Canadian legal frameworks, paid immigration or citizenship representation is strictly limited to three categories:
- Lawyers and eligible paralegals who maintain active membership in a Canadian provincial or territorial law society.
- Notaries registered with the Chambre des notaires du Québec.
- Regulated Canadian Immigration Consultants licensed through the College of Immigration and Citizenship Consultants.
Penalty Calculation and Baseline Framework
Enforcement officers assess actual financial penalties using baseline starting figures that scale upwards depending on the severity of the violation, its operational impact, any underlying financial gain, and the representative’s history of prior non-compliance. Where multiple violations occur under a single notice, combined penalties can reach the statutory cap of $1.5 million. Regulatory authorities may also order the disgorgement of financial profits resulting from misconduct.
| Violation Type | Baseline Penalty |
|---|---|
| Providing paid immigration or citizenship advice without authorization | $5,000 |
| Failing to provide required documents during a compliance inspection | $10,000 |
| Knowingly providing or helping submit false or misleading information | $15,000 |
| Multiple violations under a single notice | Up to $1.5 million |
