Expired Physical BRPs No Longer Count Under Updated UK Right to Work Rules
UK Visas and Immigration and Immigration Enforcement published a fresh employer’s guide to right to work checks on September 11, 2026, cutting off expired physical Biometric Residence Permits (BRPs) as valid proof.
If you manage hiring, HR compliance, or run a business in the UK, your onboarding checklist just got an explicit boundary. The updated manual strips out ambiguity around physical documents that have passed their expiration date, meaning you can no longer accept an expired BRP to clear a candidate for employment.

Beyond the BRP change, the updated guidance simplifies the overall compliance process and cleans up legacy terminology. Its core aim remains preventing illegal working by ensuring proper checks happen before a new hire steps onto the payroll.
When dealing with complex cases, such as a candidate with an outstanding application made before their previous leave expired, or an active appeal against a Home Office decision, the pathway involves the Employer Checking Service. If you’re reasonably satisfied the application was timely, you’ll need to lean on that service to secure a Positive Verification Notice rather than guessing at a worker’s status.
Specific penalty amounts or fine schedules were not detailed in this release of the guidance.
